KEY SKILLS: LEARNING TO FOCUS ON QUESTIONING STRATEGY & TECHNIQUE….INDENTIFY A “GOOD” WAY TO FRAME A QUESTION (OR LINE OF QUESTIONING) AS COMPARED TO A “BETTER” WAY….& DETERMING THE “best” WAY

The live session will be proceeded by two video conference sessions of one hour each which will prepare the attendees and faculty for the video conferencing sessions. We will give each attendee and faculty member an opportunity to all get to know one another and to make the live session more meaningful and productive. The session will focus on all of the steps necessary to prepare the case early knowing at some point the defense will seek and obtain a defense medical exam. We will immerse ourselves in preparing the client for the exam; setting up the protocols for the exam via court order; determining who needs to be present at the exam with plaintiff (including a videographer and third party nurse or other person); parameters of videotaping the exam; steps to take right after the exam (both client and lawyer); steps to execute the preparation and organization to ready for the setting and scheduling of the defense medical examiner’s exam; strategies and tactics in deposing the defense medical examiner; and steps to take immediately following the deposition of defense medical examiner in order to make sure a preparation is underway to successfully cross-exam the DME at trial. The faculty members will supply attendees with all of the documents and motions and briefs necessary to carry out these various motions and to set the protocols.
