KEY SKILL: LEARNING HOW TO TURN A MILD TO MODERATE TBI CASE INTO WHAT IT REALLY IS….A LIFE ALTERING BRAIN INJURY

This three and one-half hour breakout session will focus on brain injury caused by (a) hypoxia or apoxia or by (b) trauma to the brain from either a coup contra coup movement or trauma to the brain from the head striking or being struck by some object or thing. We will focus on those cases where there has also been either no loss of consciousness or (arguably) a minimal time period of LOC. This will be an interactive – “immersion session” where the faculty and students interact with one another in demonstrations and sample-settings in a “how to do it methodology.” Subjects focused upon will include urgent steps which must be taken in the first 24 hours and then four weeks in the handling of the TBI case; working with the client to make certain he/she is obtaining optimal diagnosis as well as care and treatment early on and continuously; working with treaters and experts in terms of what to do and say and to not do and what to say and what to not say; deposing treaters and experts; understanding the good-better-best techniques of questioning experts during cross-examination; undoing myths regarding voir dire strategy; “powerizing” the opening statement in TBI cases; workshopping difficult diagnostic issues and issues of general causation and specific causation; learning new and innovative techniques of cross-examination in TBI cases; and tactical considerations for summation. Attendees will be “on their feet” talking and demonstrating along with the faculty throughout the entirety of this session. This session will be preceded by two video conference call sessions of one hour each in order for the attendees and faculty to (a) meet and familiarize themselves with one another; (b) to receive “homework assignments” in order to prepare for the live session and (c) in order to discuss what steps can be taken to prepare for the live session which will make it more meaningful and beneficial for faculty and attendees alike.
