Mini Openings and Voir Dire for MIST cases

There is nothing “soft” about trying minor impact soft-tissue (MIST) cases. They are HARD as hell. Yet we all have them. Tons of them. They are sitting on your shelf right now. So dealing with these MIST cases is inevitable. And despite our gut reactions, they are legitimate and worthy. So how do we take something we dread and turn it into something we look forward to? Using the Trial by Human method, Henry will share his general playbook for how to try soft tissue cases with a focus on mini openings and voir dire.

Prior to this workshop, Henry will be sending out a fact pattern for all participants to work from. Henry will then meet with each participant via zoom before TLU Vegas to share specific outlines and guidelines for this breakout group. Each person will have the opportunity to get on their feet and deliver a mini opening followed by specific voir dire topics.

In this workshop, participants will learn how to construct a mini opening that setups an effective voir dire on topics such as:

  • Gaps in Treatment
  • No Police. No Ambulance
  • Attorney Referred Medical Care/Liens
  • Soft Tissue Injuries
  • Objective Evidence of Injury v. Subjective Complaints
  • Pre-Existing Degenerative Disease
  • Lay Witnesses v. Medical Experts
  • Not A Lot of Visible Property Damage
