Teaching the jury and telling OUR story through the Defense Medical Expert at Deposition and Trial

We all have spine cases. Far too often we settle these cases for too little. We let the insurance companies’ algorithms dictate the value of the case. We have the ability to flip that algorithm on its head through proper preparation and execution of their DME’s deposition and cross examination at trial. Done effectively we become teachers for the jury and tell the story of our case through the defense’s own expert. By doing this, we change the defense narrative and conquer the beast.

We will focus on several strategies, techniques, and methods on how to turn the defense expert into our expert including:

  • 1. Using the facts of the case against the defense medical expert
  • 2. Using the medical records against the defense expert
  • 3. Using White space
  • 4. Obtaining important concessions in almost every spine case
  • 5. Ultimately beating the medical expert at the medicine-cannot be afraid of this!
  • 6. Setting experts up early in deposition or cross for the kill shot
  • 7. Confidently asking the right questions with the right tone and demeanor at the right time

Our goal with every expert deposition should be to take the deposition in such a way that you either increase the value of the case substantially so that the case settles for YOUR number or if the case does not settle, YOU have put the case in a great position for trial. Either way you have conquered the beast.
