PSBR attorneys Lyssa Roberts and Rachel Gezerseh have orchestrated the damages work-up in wrongful death and injury cases over the past 2 years that have amounted in over $500 million in case recoveries. These extraordinary results are obtained routinely by PSBR using techniques to elicit powerful storylines and uncover character background and traits in the plaintiff and a supporting “cast of characters” that will resonate with jurors, mediators, and the defense. This breakout session will explore the development of case and trial narratives and themes through witness interviews and will include use of video interviews that illustrate how location, visual aids, and communication techniques draw out critical context for the subject incident and your client’s injuries/losses. Our discussion will specifically consider stereotypical notions of the value of non-economic damages in light of various factors.

As a participant, you will:

  • Gain hands-on experience using technology to take video/sound recordings of your clients/witnesses;
  • Practice interview techniques designed to draw out your client’s story and reveal the full scope and extent of their damages;
  • Engage in framing exercises where you will be challenged to embrace “bad” as well as “good” facts in constructing the plaintiff’s story;
  • Present the damages portion of a case you are presently working on and collaborate with the group to develop and solidify your case themes.
  • Whether it is a case going to trial or positioned to settle, this break out session will help give you tools and concepts to get the best possible outcome for your client.
